GENERAL TERMS AND CONDITIONS FOR SHOPPING ONLINE AND BY PHONE

The General Terms and Conditions are published on the website, so it is considered that every consumer who reviews the content and orders the goods is familiar with their full text.
When placing an order on the website, the consumer also explicitly confirms that he is fully aware of these conditions.
In the case of an order by telephone, the consumer is clearly informed of all the main components of these conditions. Upon receipt of the ordered products by phone, the buyer must sign a sales contract.
2. Ordering products
You can order products in online stores as follows:

Enter your personal data, name and surname, contact e-mail address and enter your order in the Question / Comment field. By clicking on the CONFIRM button, the order is completed. By clicking the CONFIRM button, you also agree with all the terms and conditions listed in the terms of business on the shop.rs-energetika.si website.
– Via the telephone number on the website
When ordering via the form on the website, it is mandatory to provide a telephone number to which we will be able to inform you free of charge about the progress of the order (all received SMS are free for you). For withdrawal from the contract, see point 9.
– through the online store shop.rs-energetika.si by selecting the desired product and putting it in the cart. Follow the purchase instructions until the final step of payment. You can pay by cash on delivery or by proforma invoice.
3. Packaging and delivery of products
Products will be delivered by Express Post GLS or Post of Slovenia in suitable package packaging. If you are not at home when you visit the postman, he will leave you a notification about the arrival of the shipment. The package with the ordered products will be waiting for you at the agreed collection point for another 5 days (GLS) or 8 days (Pošta Slovenije). You can pick it up at the agreed pick-up point within this period.
The commission for the transfer of the purchase price, which is additionally charged by GLS or Pošta Slovenije, is paid in full by the buyer.
The costs of packaging, delivery and postage for an individual one-time order of a regular offer are calculated according to the valid price list of Pošta Slovenije or GLS.
We will deliver the ordered goods, if possible, within the usual legal deadline of 30 days from the received order, but the average delivery time is 1-5 days from the received order. If it is not possible to deliver the goods within the legal 30-day delivery time, we will inform you as soon as possible about the estimated delivery time. In the event that RS Energetika does not fulfill its obligations within the legal deadline, you have the right to withdraw from the contract.
4. Sold out products
In some cases, we may not be able to deliver an individual product to you because it is sold out or we no longer have it in stock, although this is not indicated on the website. We will notify you immediately. We ask for your understanding.
5. Acceptance of products in the customer center
Acceptance in the customer center is possible at the headquarters of RS Energetika d.o.o., Remihova ulica 22, Dolga vas, 1330 Kočevje, Slovenia. It is also possible to return products to the same address.
6. Prices and special offers
All prices listed in the catalog or on the website are expressed in euros and include VAT. In addition to the price of the product, the issued invoice also includes the costs of packaging and delivery in the amount stated on the order form.
Special offers (discounts) can be weekly or daily, depending on demand and available stock.
Prices are valid from 6.2.2020 until canceled or changed.
7. Payment
You pay for the ordered products as follows:

In the 1st case, you pay for the goods in cash upon receipt, whereby the cost of transferring the money (i.e. the deposit) is covered by the buyer. In the case of sending with the GLS delivery service, payment with a Maestro, MasterCard or Visa bank card is also possible upon receipt;
In the 2nd case, you pay for the goods through your online bank, where the bank charges you a commission for the payment of the UPN order according to its valid price list;
Legal entities are subject to the same conditions for ordering and paying for products.
We also reserve the right to deliver only against payment by proforma invoice.
In the event that the customer does not take over the ordered goods, in the future only payment by proforma invoice is possible.
8. Reservation of title
We reserve the right of ownership over the sold products and they remain the property of RS Energetika even after they have been handed over to you, until you pay the purchase price for them in full.
9. Order cancellation
You can cancel orders received via website, phone or e-mail at no extra cost:
- upon delivery to home or. the selected address until you receive an electronic and / or SMS message in which you will be informed that the goods have been handed over to the delivery service;
- upon delivery to the point of sale until collection at the point of sale.
Notice of cancellation of the order can be sent via e-mail address, contact form on the website or via telephone number +386 (0)41 676 870. The provider does not guarantee that the order can be successfully stopped. Partial order cancellation is not possible. If you want to cancel only individual order items, we advise you to cancel the entire order and then create a new order with the newly selected items.
10. Withdrawal from the contract – return of products and refund of purchase price
As a customer, you have the right to notify us within 14 days of receiving the items that you are withdrawing from the contract without having to give a reason for your decision. Withdraw from the contract by informing us via the contact form or sending a message to info@rs-energetika.si.
The deadline starts one day after the date of receipt. The cost of return is borne by the buyer. Items must be returned to the bidder no later than 14 days from the submission of the notice of withdrawal from the contract (purchase). If the customer may have already started using the item or if he has already opened and assembled individual components for technical products, withdrawal from the contract is unfortunately no longer possible.

The buyer must return the received items undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased through no fault of the buyer. The manufacturer of the article also prescribes its original packaging (in accordance with Article 36 of the Consumer Protection Act). As the packaging is an integral part of the item, it must also be attached, as it was in the original condition upon receipt of the item (ie undamaged and unchanged).
In the case of return of products, the cost of postage is borne by the customer, unless otherwise agreed.
Returning products must be accompanied by a copy of the invoice and your personal data together with the number of the personal bank transaction account to which we will refund your money. If you have already paid for the delivered goods, we will refund the purchase price you paid for the returned products.
When returning the goods, write the number of your personal transaction bank account in the personal data, where the paid purchase price should be transferred – if you have access to the printer, you can print a form. It is not possible to return the purchase price in cash or by postal order.
We will refund your money as soon as possible and no later than 14 days after receiving notice of withdrawal.
Failure to accept the package or return the products within 30 days of receipt of the ordered goods is also considered a notice of withdrawal from the contract.
11. Warranty
All electronic devices have a 1-year quality guarantee. The warranty runs from the date of purchase / delivery. Warranty conditions are printed on the back of the received invoice or from the product instructions that you receive upon delivery of the goods. Unless otherwise stated in the product instructions, inspection and troubleshooting are performed by RS energetika. If this lasts more than 45 days, we will replace the product with a new one, and if this is not possible, we will refund the purchase price for the product in full.
In case the product does not work properly or does not work in accordance with your expectations, write to us via the contact form, send a message to info@rs-energetika.si or call +386 (0)41 676 870, where we can help you with the necessary explained. You can send the purchased products to us for service inspection by post in suitable package packaging.
12. Actual errors
If material defects appear on the product within 2 years after receipt, the user must notify the provider of the defect within the statutory period and describe the defect in more detail in the defect notification and allow the provider to inspect the product. The legal provisions of the Code of Obligations and the Consumer Protection Act apply in this regard.
The error is real:
– if the thing does not have the properties necessary for its normal use or for marketing;
– if the thing does not have the properties necessary for the special use for which the buyer is buying it, but which was known to the seller or should have been known to him;
– if the thing does not have the characteristics and qualities that were explicitly or tacitly agreed or prescribed;
– if the seller has delivered an item which does not correspond to the sample or model, unless the sample or model was shown only for the purpose of notification.
13. Accountability and dispute resolution
RS Energetika is not responsible for any complications or problems that may arise from the incorrect use of the product. Also, the employees of the RS Energetika online store help center are not responsible for personally resolving any problems with the use of the product. Communication takes place exclusively via the website, e-mail or telephone. Personal visits and demonstrations of products on the company’s premises are not possible. In case of complaints, follow point 10.
RS Energetika does not recognize any of the providers of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
